1. the agreement

These terms are an agreement between you and Jotter app (“we”, “us”), the developer of jotter (the “app”). By downloading or using the app you agree to them. They apply alongside Apple's Licensed Application End User License Agreement; where the two differ, these terms apply to the extent permitted. Our privacy policy explains how information is handled.

2. your licence

We grant you a personal, non-transferable, non-exclusive licence to use the app on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including through Family Sharing where it is enabled. You may not copy (except as the Usage Rules allow), modify, reverse-engineer, decompile, rent, lease, sell or redistribute the app, or remove any notices from it, except where the law expressly allows.

3. jotter pro and subscriptions

The notebook is free. jotter pro unlocks reminders, iCloud sync, dusk and night paper, twelve more handwriting styles, the Face ID lock and PDF export. It is offered as:

Prices vary by country and may include tax; the price in your currency is always shown in the app and by the App Store before you confirm.

4. your content

You own everything you write in jotter. We claim no rights to it, and we don't receive it: your pages are stored on your device and, if you choose, in your own iCloud. You're responsible for your content and for keeping your own copies. We recommend iCloud sync or exporting your notebook from time to time; we can't recover pages we never had.

5. acceptable use

Use the app lawfully. Don't use it to break the law, to infringe anyone's rights, or to interfere with the app, its purchases or any service it connects to.

6. Apple services

Some features rely on services provided by Apple, such as iCloud, notifications, Siri, widgets and Face ID. Your use of them is governed by Apple's own terms, and they may change or be unavailable at times outside our control.

7. our intellectual property

The app, including its design, artwork, sounds, the jotter name and logo and its code, belongs to us or our licensors and is protected by law. Typefaces included under the SIL Open Font License are provided under that licence; copies are bundled with the app. Pictures you share include a small “jotter.” mark; you may share them freely.

8. no warranty

To the maximum extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the app will be uninterrupted or error-free, or that reminders or sync will always be delivered on time.

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our responsibility, not Apple's, to the extent they cannot be disclaimed.

9. limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of or inability to use the app. Our total liability for any claim is limited to the amount you paid for the app and jotter pro in the twelve months before the claim.

Some jurisdictions don't allow these exclusions or limits, so they apply only as far as your local law permits. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

10. App Store terms

If you got the app from Apple's App Store, you and we acknowledge that:

11. ending, changes and governing law

You can stop using the app at any time by deleting it; cancel any subscription separately as described in section 3. Your licence ends automatically if you break these terms. We may update the app and these terms; for material changes we'll update the date above and tell you in the app, and continuing to use the app after that means you accept them. These terms are governed by the laws of the place where the developer is established, without regard to conflict-of-law rules, but you keep the protection of any mandatory consumer law of the country where you live and may bring claims in your local courts where that law allows. If any part of these terms is unenforceable, the rest stays in effect.
